2. Service Purpose
Chatyx is a SaaS platform that enables businesses to easily create smart chatbots trained on their own data sources (web pages, PDF documents, knowledge bases, etc.). These chatbots can be deployed on websites and third-party apps like WhatsApp or Telegram. The service includes a free plan as well as monthly and yearly subscription options, designed to automate customer support and simplify user interactions.
3. Pricing and Payment
Prices are listed in euros (€), excluding tax (HT). In accordance with French law (Article 293 B of the General Tax Code), VAT is not applicable (tax-exempt status). Payment is due immediately upon subscribing to a paid plan. All payments are processed securely via credit card (through Stripe). By subscribing, the user explicitly authorizes Chatyx to automatically charge the selected subscription amount.
4. Duration, Renewal & Cancellation
Chatyx subscriptions are non-binding. Subscriptions renew automatically at the end of each chosen billing period (monthly or annually).

No further charges will apply after the effective cancellation date.
5. Refund Policy
No refunds are offered for monthly subscriptions.
For annual plans, a refund may be granted under the following conditions:
The request is made within 14 days of the initial subscription.
The user provides clear and verifiable proof of malfunction or unusable service directly attributable to Chatyx.

6. Usage Limits and Fair Use
Each subscription (free or paid) grants access to a defined set of features and resources, including the number of chatbots, integrations, message limits, and storage. These limits are clearly stated on the website at the time of subscription.
Chatyx reserves the right to suspend access in the event of abusive, fraudulent, or clearly excessive use beyond what is allowed under the selected plan.
7. Support and Technical Assistance
Chatyx provides an intelligent chatbot on its website to answer frequently asked questions. Human assistance is also available by email at: [email protected].
8. Service Availability and Liability
Chatyx commits to providing a reliable, stable, and secure service. However, the user acknowledges that temporary interruptions may occur due to maintenance, updates, or technical issues. Chatyx will strive to minimize downtime but shall not be held liable for any temporary unavailability of the service, and no compensation shall be due.
9. Personal Data and Privacy
Chatyx strictly complies with the General Data Protection Regulation (GDPR). Personal data is collected and processed only for the purposes of operating the Chatyx service and managing subscriptions. Data is never sold, shared, or used for third-party commercial purposes.

11. Changes to the Terms of Service
Chatyx reserves the right to update these Terms of Service at any time. Users will be notified via email or through a clear notice in their dashboard prior to the enforcement of any new terms. Continued use of the service after notification constitutes explicit acceptance of the changes.
12. Governing Law and Jurisdiction
These Terms are governed by French law. In case of a dispute that cannot be resolved amicably, only French courts will have jurisdiction.
